Focused Implementation of Customs Management at ICD Móng Cái Dry Port

In order to take advantage of the advantages of Mong Cai Border Gate Economic Zone in border trade activities with China, Quang Ninh Customs Department has proposed to the People’s Committee of Quang Ninh Province to petition the Prime Minister to allow the implementation of the experiment. Specific mechanism points at Mong Cai ICD dry port. This will facilitate trade activities, avoid congestion at international seaports and significantly reduce costs for businesses.

Talking to Customs Newspaper reporters, Mr. Tran Quang Trung – Director of Mong Cai Border Gate Customs Branch said that in recent years, the flow of import and export goods between Vietnam and China through international border gates has increased. Mong Cai increased rapidly, especially temporarily imported and re-exported goods transported by container. Most of the above transported goods belong to Quang Ninh enterprises, headquartered in Mong Cai city.

Because the destination port is usually Hai Phong port, businesses have to go through customs procedures in Hai Phong and hire water or land transport to Mong Cai before exporting to China. This greatly affects travel time, effort, costs as well as causes risks for businesses. Furthermore, in recent times, seaports in Hai Phong have always had cargo congestion because the seaport infrastructure and transportation infrastructure have not met the requirements.

Therefore, to reduce congestion at seaports and address the backlog of goods, the Quang Ninh Customs Department has proposed to the Quang Ninh Provincial People’s Committee to petition the Prime Minister for approval to pilot a special mechanism at the ICD Mong Cai inland port.

Mr. Tran Quang Trung added that the ICD Mong Cai inland port in Quang Ninh Province is located at Km3+4 Export Point. However, under current regulations, inland ports are not permitted to engage in cross-border import-export activities as a border gate. The customs clearance location at the inland port is limited to certain types of import-export goods. For other types, such as goods for temporary import and re-export, bonded warehouse goods, or specific categories restricted to customs clearance at the import border gate as regulated by the Prime Minister, activities will primarily occur at Km3+4 Mong Cai inland port, and the authority to resolve these matters falls under the jurisdiction of the Prime Minister.

In order to reduce administrative procedures and facilitate import and export activities through Mong Cai ICD, and at the same time take advantage of the advantages of Mong Cai Border Gate Economic Zone in border trade activities with China, Quang Ninh Customs Department has proposed to the People’s Committee of Quang Ninh province to recommend to the Prime Minister to allow the pilot implementation of a special mechanism that, in addition to the function of the dry port as prescribed in Decision 47/2014/QD-TTg, allows Mong Cai ICD to operate as a road border gate, to carry out customs procedures for all types of imported and exported goods, including: Export and import of goods and within a specific time according to the announcement of the People’s Committee of Quang Ninh province for cross-border trading of goods by traders; transit; temporary import and re-export of goods according to the temporary import and re-export business method; goods sent to bonded warehouses are transported from the import border gate to carry out customs procedures at the dry port for all goods.

Understanding the importance and role of promoting economic development of ICD Mong Cai, on January 10, 2017, the Prime Minister’s Office issued an official dispatch notifying the Prime Minister’s opinion of agreeing to allow ICD Km3+4 Mong Cai to import, export and re-export goods. This means that ICD Mong Cai will have its own operating mechanism. Enterprises will be able to open declarations directly at the port, without having to transfer to the border gate as before. Supervision of transported goods will be more convenient because goods arriving at Hai Phong port will be transferred to ICD Mong Cai to complete procedures…

However, along with the mechanisms, there are also requirements for customs supervision here to be prepared scientifically to both facilitate and manage closely.

The Head of Mong Cai Border Gate Customs Branch said that, based on the functions, tasks, powers and organizational structure of the Customs Operation Team at Thanh Dat ICD, under Mong Cai Border Gate Customs Branch, Quang Ninh Customs Department has proposed to implement customs procedures at Mong Cai ICD dry port. Specifically:

Organize the implementation of declaration registration, reception, physical inspection and supervision of goods at the Customs Operation Team at Thanh Dat ICD for goods exported and imported through Mong Cai ICD dry port to China and vice versa for all types of export, import and re-export. Temporarily imported and re-exported goods are implemented according to the direction of the Prime Minister.

In addition, regulations on traders and goods traded through Mong Cai ICD, to ensure consistency in the management of cross-border import and export activities of traders, for cases where traders conduct import and export activities to China and vice versa, they must meet the conditions specified in Circular 34/2016/TT-BCT dated December 28, 2016 of the Ministry of Industry and Trade.

Currently, Quang Ninh Customs Department is urgently preparing to issue a Decision regulating state management of customs at the customs clearance location at the inland import and export port of goods established at Km3+4, Mong Cai city, Quang Ninh province. This Decision will replace the content in Section IV, Part B, Regulations on supervision of exported and re-exported goods and means of transport passing through the border area at Mong Cai border gate, Customs clearance point in Mong Cai border gate economic zone, Mong Cai city, Quang Ninh province (according to Decision No. 798/QD-HQQN dated October 7, 2015 of the Director of Quang Ninh Provincial Customs Department).

Since 2009, the People’s Committee of Quang Ninh province has agreed to allow Thanh Dat Joint Stock Company to carry out procedures to establish an ICD port in Km3+4 area, Hai Yen ward, Mong Cai city. By October 2015, the Ministry of Transport issued a decision to announce the establishment of an ICD port to promote the smooth development of import-export activities in Mong Cai.

On April 8, 2016, the Ministry of Finance issued Decision No. 897/QD-BTC establishing a Customs Clearance Location at the inland port of export and import of goods at Km3+4, Mong Cai City, Quang Ninh. Immediately after that, Quang Ninh Customs instructed Thanh Dat Joint Stock Company (investor) to complete the dossier and conditions for establishing a customs clearance location at the inland port of export and import of goods (inland port).

On June 7, 2016, the General Department of Customs issued a decision to establish a Customs Operation Team at Thanh Dat ICD, under the Mong Cai Border Gate Customs Sub-Department, Quang Ninh Customs Department.
